(Federal Intelligence Service – foreign surveillance)
In its judgment pronounced today, the First Senate of the Federal Constitutional Court held that the Federal Intelligence Service (Bundesnachrichtendienst – BND) is bound by the fundamental rights of the Basic Law when conducting telecommunications surveillance of foreigners in other countries, and that the statutory bases in their current design violate the fundamental right to the privacy of telecommunications (Art. 10(1) of the Basic Law, Grundgesetz – GG) and freedom of the press (Art. 5(1) second sentence GG). This applies to the collection and processing of data, the sharing of data thus obtained with other bodies and the cooperation with foreign intelligence services. At the same time, the Court held that statutory bases for the surveillance of foreign telecommunications can be designed in conformity with the Constitution.“

Defence intelligence agencies gather, analyse and retain a wide range of information which supports Government decision making.
Australian intelligence agencies are legally bound by the Intelligence Services Act 2001 (ISA).
Intelligence Services Act
ISA provides the legal framework for the activities of the foreign intelligence collection agencies, including the Australian Geospatial-Intelligence Organisation. ISA regulates the agencies via:
rules about protecting the privacy of Australians
special directions from their respective Ministers
provision of oversight and accountability measures
protection of classified materials
protocols for the use of open source information
other general limitations.“
